Terms of Service

1. Agreement to Terms
By accessing or using TutorKit (tutorkit.com and related services, collectively the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
These Terms constitute a legally binding agreement between you and TutorKit (“we,” “us,” or “our”). We may update these Terms from time to time. We will notify you of material changes before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
2. Eligibility
You must be at least 18 years old to use TutorKit. By creating an account, you represent and warrant that you are at least 18 years of age. If we become aware that a user is under 18, we will terminate their account and delete their data.
3. Your Account
To use TutorKit, you must create an account. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us promptly if you suspect unauthorized access
You may not share your account credentials with others or operate multiple accounts to circumvent usage limits. We reserve the right to suspend or terminate accounts that violate these Terms.
4. The Service
4.1 Description
TutorKit is a personalized learning platform that provides AI-powered educational courses and interview preparation tools. The Service uses automated systems to personalize your experience based on your interactions. The specific technologies and methods we use are proprietary.
4.2 AI-Generated Content
All course content, tutor responses, interview questions, and feedback provided through the Service are generated by artificial intelligence. You acknowledge and agree that:
- AI-generated content is provided for educational and informational purposes only.
- AI-generated content is not a substitute for professional instruction, accredited education, certification programs, or professional advice of any kind (including legal, medical, financial, or career advice).
- AI-generated content may contain errors, inaccuracies, omissions, outdated information, or biases.
- We make no representations or warranties regarding the accuracy, completeness, reliability, or fitness for any particular purpose of AI-generated content.
- You are solely responsible for evaluating and independently verifying any information provided by the Service before relying on it for any decision.
- Interview preparation feedback is coaching guidance only and does not guarantee interview success or any particular outcome.
- You assume all risk associated with your use of and reliance on AI-generated content provided through the Service.
4.3 Content Moderation
We take reasonable steps to filter harmful, offensive, or inappropriate content from AI-generated outputs. However, due to the nature of AI systems, we cannot guarantee that all output will be appropriate, accurate, or free from bias. If you encounter problematic content, please report it to support@tutorkit.com. We are not liable for AI-generated content that you find objectionable or that causes harm.
4.4 Third-Party AI Services
The Service relies on third-party artificial intelligence providers to generate content and analysis. These providers operate under their own terms and policies, which may change over time. We are not responsible for the acts, omissions, or policies of third-party providers. By using the Service, you acknowledge that your content will be processed by third-party AI services as described in our Privacy Policy.
4.5 Service Availability
We aim to keep the Service available but do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
5. Subscriptions and Payments
5.1 Tiers
TutorKit offers a free tier with limited features and a paid subscription tier. The features and limits of each tier are described on our pricing page and may change over time.
5.2 Payment
Paid subscriptions are billed through our third-party payment processor on a recurring basis (monthly or annually).
- You authorize recurring charges to your payment method until you cancel.
- If payment fails, we may suspend your paid access until payment is resolved. Your data will be retained during billing disputes.
5.3 Cancellation
You may cancel your paid subscription at any time from the Settings page. Upon cancellation, you retain paid access until the end of your current billing period. After that, your account reverts to the free tier. Your data is not deleted upon downgrade.
5.4 Refunds
Refund eligibility is determined on a case-by-case basis. Contact support@tutorkit.com for refund requests.
5.5 Price Changes
We may change subscription prices with advance notice. Price changes apply to the next billing cycle after the notice period. You may cancel before the next billing cycle if you do not agree with a price change.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Infringe on the intellectual property rights of others
- Upload or transmit malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to our systems, other users' accounts, or any data you are not authorized to access
- Use automated tools (bots, scrapers, crawlers) to access the Service without our written permission
- Attempt to extract, reverse-engineer, or derive the underlying models, algorithms, training data, or proprietary methods used by the Service or its third-party providers
- Attempt to manipulate, bypass, or circumvent safety filters, content moderation, or usage restrictions of the AI systems
- Use the Service for purposes unrelated to personal learning and interview preparation
- Harass, abuse, threaten, or harm others through the Service
- Share account credentials or operate multiple accounts to circumvent usage limits
- Resell, redistribute, sublicense, or commercially exploit the Service or its outputs without our written permission
- Misrepresent AI-generated content as human-created work in contexts where such misrepresentation is deceptive or prohibited
We reserve the right to suspend or terminate accounts that violate these rules, with or without prior notice depending on the severity of the violation.
7. Intellectual Property
7.1 Our Property
The TutorKit platform, including its design, branding, features, proprietary algorithms, models, methods, and underlying technology, are owned by us and protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property except the limited right to use the Service as described herein.
7.2 Your Content
You retain ownership of the content you create and input into TutorKit. By using the Service, you grant us a limited, non-exclusive, royalty-free license to use your content for the following purposes:
- To provide and operate the Service (including processing your content through AI systems, storing it, and displaying it to you)
- To generate personalized insights and analysis for your use
- To improve the Service using anonymized and aggregated data that cannot identify you
This license terminates when you delete your account or request data deletion, except with respect to anonymized and aggregated data already derived from your content.
7.3 AI-Generated Output
Content generated by the Service (course materials, feedback, analysis) is provided for your personal, non-commercial use. You may use AI-generated content to assist with your learning and interview preparation. You may not resell, publish, or commercially distribute AI-generated content from TutorKit without our written permission.
8. Limitation of Liability
To the maximum extent permitted by applicable law, TutorKit and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or relating to your use of or inability to use the Service, regardless of the theory of liability.
Without limiting the foregoing, we are specifically not liable for:
- Any decisions you make based on AI-generated content, including career decisions, interview outcomes, academic choices, or any other personal or professional decisions
- Errors, inaccuracies, biases, or omissions in AI-generated content
- Harmful, offensive, or inappropriate content generated by AI systems despite our content moderation efforts
- Loss of data, including user-generated content or derived profile data
- Actions, omissions, or policy changes of third-party service providers (including AI providers and payment processors)
- Unauthorized access to your account resulting from your failure to maintain credential security
To the maximum extent permitted by applicable law, our total aggregate liability to you for all claims arising from or related to the Service shall not exceed the greater of (a) the amounts you paid to us in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, or uninterrupted availability.
We do not warrant that: the Service will meet your specific requirements or expectations; AI-generated content will be accurate, complete, current, or error-free; the Service will be available without interruption; any defects in the Service will be corrected; or the Service will be free of viruses or other harmful components.
You use the Service at your own risk and discretion. You are solely responsible for any damage to your device or loss of data resulting from your use of the Service.
10. Indemnification
You agree to indemnify, defend, and hold harmless TutorKit, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from or relating to: your use of the Service; your violation of these Terms; your violation of any applicable law or third-party rights; or content you submit through the Service.
11. Dispute Resolution
11.1 Informal Resolution
Before initiating any formal legal proceeding, you agree to contact us at legal@tutorkit.com and attempt to resolve the dispute informally.
11.2 Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
11.3 Arbitration
Any disputes that cannot be resolved informally shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA), conducted in California. You agree to waive your right to a jury trial and to participate in class action lawsuits or class-wide arbitration against TutorKit.
11.4 Exceptions
Either party may seek injunctive or equitable relief in a court of competent jurisdiction for matters relating to intellectual property rights, unauthorized access, or violations of Section 6 (Acceptable Use).
12. Termination
12.1 By You
You may close your account at any time through the Settings page. Upon closure, your data will be handled as described in our Privacy Policy.
12.2 By Us
We may suspend or terminate your account if: you violate these Terms; your account shows no activity for an extended period; required by law; or necessary to protect the safety, security, or integrity of the Service or its users.
Where practicable and not prohibited by law, we will provide advance notice before terminating your account for reasons other than a Terms violation. For paid subscribers terminated due to reasons other than a Terms violation, we will provide a prorated refund for any unused subscription period.
13. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and TutorKit regarding the Service and supersede all prior agreements.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.
- No Waiver: Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.
- Assignment: You may not assign your rights or obligations under these Terms. We may assign ours in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law.
- Force Majeure: We are not liable for any failure or delay caused by events beyond our reasonable control.
- Notices: We may provide notices to you via email to the address associated with your account or through the Service. You may provide notices to us at legal@tutorkit.com.
